Warranty

Plant Warranty

All plants purchased and installed by Rhine Landscaping shall be warranted for a period of one (1) year from the date of installation. If any plants die within the one year period, they will be replaced at no additional cost to the owner for labor or materials. Only plants greater than 50% dead or having a dead main leader will be considered for replacement. Rhine Landscaping shall be responsible for a one-time replacement only. Replacement plants are not warranted. Cash refunds will not be provided. This warranty is void if the purchaser fails to pay in full for the materials and services stated in the contract for which the plants are warranted. Rhine Landscaping reserves the right to delay plant replacements until the appropriate planting season. The warranty specifically excludes:

Perennials, annuals, groundcovers, bulbs, grass seed, and sod;

Transplanted plants;

Plants damaged by animals (wild or domestic), insects, or disease;

Plants damaged by neglect or abuse (including improper watering);

Plants damaged by vandalism, theft, machinery, or chemicals;

Plants damaged by extreme weather conditions;

Plants removed prior to inspection by a Rhine representative.

Construction Warranty

All materials and equipment purchased and installed by Rhine Landscaping shall be warranted against any defect or cosmetic imperfection for a period of one (1) year from the date of installation. Specific manufacturer’s warranties extending beyond one (1) year will be transferred to the owner. Furthermore, all hardscape construction installed by Rhine Landscaping shall be warranted for structural stability and craftsmanship for a period of five (5) years from the date of installation. If any hardscape element develops a failure such as cracking or settling, Rhine Landscaping should be contacted immediately. When applicable, all labor and materials used to correct the problem shall be provided at no additional cost to the owner. Cash refunds will not be provided. This warranty is void if the purchaser fails to pay in full for the materials and services stated in the contract for which the hardscape elements are warranted. This warranty specifically excludes:

Natural shrinkage, checking, and warping of wood/composite structures;

Hairline cracks is masonry;

Staining, efflorescence, leaching, bleeding, or other discoloration of natural stone;

Damage caused by neglect or abuse;

Damage caused by vandalism, theft, machinery, or chemicals (including de-icing salts);

Damage caused by ‘Acts of God’.

Rhine Pool Warranty

Rhine Pools hereby warrants the pool shell to be free of defects in material and workmanship and shall remain structurally sound for as long as the pool is owned by the original purchaser. By definition, the pool shell shall consist of the reinforced concrete portion of the pool. Items such as tile, coping, finish, plumbing, electrical, pumps, heaters, filters and other mechanical systems are not part of the pool shell.

All pool equipment including but not limited to plumbing, electrical, pumps, heaters, filters, chlorinators, and controls shall be warranted for a period of one (1) year from the date of final payment. Any manufacturer’s warranties extending beyond one year will be extended to the owner.

The pool finish shall be warranted against any defects in material and workmanship for a period of three (3) years from the date of final payment. The finish is not warranted against discoloration or staining.

Limitations

The warranties are effective only if owner has complied with all term and conditions, monetary payments, and other provisions of this contract. The warranties will become void as a result of any of the following conditions or events:

The pool is not kept full of water except for short periods of less than seven (7) consecutive days.

Damage by the elements or Acts of God, war, terrorism, civil disturbances, unusual abuse, neglect, improper use of chemicals, incorrect operation or lack of care of the pool or equipment.

Warranty Claim Process

Anyone wishing to make a warranty claim shall notify Rhine Landscaping in writing immediately upon noticing the problem. At a minimum, the written claim shall include the project address, date of purchase, date of completion, name of sales representative, and a detailed description of the problem accompanied by photographs. Once the written claim has be received, a representative of Rhine Landscaping will schedule a meeting to determine the extent of the damage and recommend the necessary steps to correct the problem. Please allow 6-8 weeks for your claim to be processed and remediated.
